Copyright Policy

  1. 1. Copyright Ownership & User Responsibility
    1. All content uploaded to Channels (as defined in Terms and Conditions of Service (“Openrice’s Terms and Conditions”)) (the “Openrice Platforms”), including but not limited to text, photos, images, videos, audio, music, reels and any other materials (collectively, the “Content”) remains the intellectual property of its respective creators.
    2. Users of the Channels (“Users”) are solely responsible for ensuring that any music, images, videos or other media included in their uploads do not infringe third-party copyrights. They must obtain all necessary permissions or licenses from the relevant copyright owners or licensing agencies before incorporating such content.
    3. Openrice does not claim ownership over user-generated content and does not actively modify or sublicense such content for editorial purposes, unless authorized under Openrice’s Terms and Conditions. However, by uploading or posting the Content, Users unconditionally grant Openrice a royalty-free, transferable, sub-licensable, worldwide and non-exclusive, perpetual, irrevocable license to use, reproduce, adapt and display such Content for operational and platform-related purposes, including but not limited to formatting, technical adjustments, and compliance-related modifications, translation, caption creation and platform development. Where permitted under Openrice’s Terms and Conditions, Content may be featured or distributed for commercial purposes. Content will be accessed across Openrice Platforms and its affiliate platforms in different regions. Openrice also reserves the right to remove, restrict access to, or disable Content that violates or is reasonably suspected to violate copyright laws or infringes third-party rights.
    4. Users shall indemnify and hold Openrice harmless, including its officers, directors, employees, agents, partners, representatives, shareholders, attorneys, predecessors, successors, and assigns, from and against any claims, actions, demands, liabilities, losses, damages, costs, and expenses (including legal fees and litigation expenses on a full indemnity basis) arising from their infringement of any third-party copyrights, breach of any provision of Openrice's Terms and Conditions or any unauthorized use of copyrighted material uploaded to Openrice Platforms.
  2. 2. Copyright Infringement Notice Procedure
    1. To file a copyright complaint, rights holder or his/her authorized representative must provide Openrice with a signed notice contains:
      1. Particulars of the complainant (including full name, address for service in Hong Kong, contact telephone number and email address);
      2. Identification of the copyrighted work allegedly infringed;
      3. Specific details of the infringing content (e.g., URLs, screenshots);
      4. Proof of ownership of the copyrighted material;
      5. Statement of good faith belief that the use is unauthorized; and
      6. A declaration that the information provided is true and accurate and the complainant understands that it is an offence to make any false statement in this notice.
  3. 3. Counter Notice Procedure
    1. A User may submit a counter notice if he believes his content was removed in error. The counter-notice must be signed by the User and contains sufficient justification including the following information:
      1. Particulars of the User (the “Respondent”) (including full name, address for service in Hong Kong, contact telephone number and email address);
      2. Identification of the copyrighted work/material in question;
      3. Statement of good faith belief that the removal or disabling of access was the result of a mistake or misidentification;
      4. The detailed ground(s) on which the Respondent relies in making the statement set out in paragraph c above, together with the relevant proofs;
      5. Whether the Respondent agrees to the disclosure of his personal data herein to the complainant; and
      6. A declaration that the information provided is true and accurate and the Respondent understands that it is an offence to make any false statement in this notice.
  4. 4. Failure to follow Copyright Infringement Notice Procedure or Counter Notice Procedure
    1. If a copyright holder or User fails to submit a proper notice, Openrice may not be obligated to take any action. However, it reserves the right to take proactive steps to mitigate legal risks, including restricting access or removing the infringing material.
  5. 5. User Liability & Repeat Infringers
    1. Users are fully responsible for ensuring their uploaded content complies with copyright laws. Openrice reserves the right to suspend or terminate accounts of repeat infringers who persistently violate copyright laws.
  6. 6. Legal Compliance
    1. Openrice complies with applicable copyright laws and regulations in the jurisdictions where it operates. It follows standard notice-and-takedown procedures and accommodates the standard technical measures used by copyright owners to protect their rights.

  8. 8. Inconsistency
    1. Should there be any inconsistency between the English version and any version in other language, the English version shall always prevail.
